Suggo Creations provides digital assets (sometimes referred to as "content" or "product(s)"). These include, but aren't limited to, 3D models, 2D artwork, audio, programming
and related concepts and ideas as its content.
Suggo Creations is a registered sole proprietorship owned and operated by Wessel Freriks, based in the Netherlands. Chamber of Commerce No. 81037813
1. Terms
You acknowledge and agree that, by accessing, purchasing or using the services,
you are indicating that you have read, understand and agree to be bound by the agreement.
If you accept or agree to the Agreement on behalf of a company, organization or other legal entity,
you represent and warrant that you have the authority to bind that Legal Entity to the Agreement.
By accessing suggocreations.com and its subdomains, Suggo Creations assumes you accept these Terms and Conditions,
all applicable laws and regulations, and agree that you are responsible for
compliance with any applicable local laws. If you do not agree with any of
these terms, you are prohibited from using or accessing this site. The materials
contained in Suggo Creations are protected by applicable copyright.
2. Use License
2.1 Use License First party
When content is purchased directly from Suggo Creations (first party), a worldwide, perpetual license is granted to use the content personally, commercially and non-commercially.
This is the grant of a license, not a transfer of title, and under this license you may not:
⚬ Republish material from Suggo Creations
⚬ Sell, rent or sub-license material from Suggo Creations
⚬ Reproduce, duplicate or copy material from Suggo Creations
⚬ Redistribute content from Suggo Creations
Suggo Creations reserves the right to use any of its content for its own promotional, commercial and non-commercial uses
unless agreed otherwise with the customer or client.
2.2 Use License Third party
Content purchased and consumed non-directly from Suggo Creations - that has been put there by Suggo Creations - are bound by that third party's own Use License in their Terms of Service or Terms and Conditions.
3. Copyright
All content on this site is property of Suggo Creations or third parties who have given us permission to publish their content. No content on this site may be used without prior written permission from Suggo Creations.
4. Disclaimer
Content provided by Suggo Creations are 'as is'.
Suggo Creations makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties,
including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose,
or non-infringement of intellectual property or other violation of rights. Further, Suggo Creations does not warrant or make
any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise
relating to such materials or on any sites linked to this site.
Because some jurisdictions do not allow limitations on implied warranties, or
limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Any use of the Website or its content is entirely at your own expense and risk.
You agree to indemnify Suggo Creations and hold Suggo Creations harmless from and against all claims (by third parties) which may
in any way be connected with the Website, its content or any use of the same.
5. Payment
After an offer (that includes workhours, costs) has been accepted, work will begin on the content requested.
Once the content has been finished or close to being finished, an invoice will be sent.
Invoices must be paid within 30 days of the invoice being received.
If the purchaser pays the invoice after the 30-day payment term, it will owe statutory interest over the period exceeding the 30-day payment term.
If you, as a customer, do not pay your invoice in time or not at all, Suggo Creations is allowed to:
⚬ Charge a standard fee for collection costs.
⚬ Charge a reasonable compensation for expenses incurred, such as legal fees of collection costs.
⚬ To charge statutory interest, calculated from the date the payment term expires.
6. Guarantee
Under Dutch Consumer Law, Suggo Creations provides a guarantee to customers or clients who have bought any product or service resulting in a product
directly from Suggo Creations (first party). This law states that you, as a customer and purchaser of these products, are legally entitled to a sound product.
A product is not sound if it:
⚬ is incomplete.
⚬ is damaged.
⚬ is broken or isn't functional.
⚬ if you cannot use the product as it is advertised.
If your purchased content is any of the above, Suggo Creations will repair or provide a replacement of the product, unless it can be proven by Suggo Creations
that the product has become defective due to user error or wrongly handling of the product within the first 6 months of purchase.
If your purchased content becomes defective after 6 months, you, the customer and purchaser of the product, has to prove that it is the product's fault and not
user error or wrongly handling of the product.
Be aware of your rights; if you are not a Dutch citizen, this guarantee may not apply.
If your content has been purchased on a third party site, this guarantee may not apply.
If your content has been acquired through illegitimate means (which include - but aren't limited to - unofficial downloads, filesharing, duplication) this guarantee does not apply.
If your purchased content has been modified, this guarantee does not apply.
